FAQ's
Timeline & Process
What is the estimated time for the entire process?
About 6 hours total across the 9 to 12 month process.
What documents or proof do I need to provide?
Usually just proof of authorship, such as original files, dates of creation, or links to your official shop. We’ll guide you on exactly what’s needed.
How long does it take to see any results?
On average, 9 to 12 months.
Trust & Legitimacy
How did you find my artwork?
We identify artists through active counterfeit investigations. We only reach out if we’ve already seen your work targeted by counterfeiters.
Who is Edwin James IP?
We’re a UK-based company that’s represented artists worldwide since 2018. When we contact an artist, it’s because we’ve already confirmed their work has been copied. There’s no cost to take part.
Why do you need my copyright if I already made the art?
Ownership gives you rights; registration provides enforceability. To pursue legal damages, we need proof of registration, so the court recognizes your copyright claim.
Money & Damages
Can you share a ballpark range of damages that may be awarded?
We can’t guarantee exact figures, but most artists recover between 5 figures (50%) and 6 figures (33%) in total, depending on the strength of the case.
What percentage does Edwin James IP take?
Damages are split as follows:
- Edwin James IP: 40%
- Lawyers: 30%
- Artist: 30%
This covers our case team, legal partners, and all costs of pursuing the case.
Is there any cost to me?
No. There are no out-of-pocket costs. We only move forward when we’re confident in your case, and we cover everything.
Are there any hidden fees?
No. There are no hidden fees or surprise charges. The split above is exactly how it works.
Legal Involvement
Will I need to go to court?
No. Our partnered attorneys handle everything on your behalf, and you won’t need to appear in court.
Will my name be made public?
In most cases, no. Legal filings usually list Edwin James IP or the attorney of record. If there’s ever a reason your name would appear, we’ll discuss it with you first.
Do I need to hire a lawyer?
No. Legal support is built into the process. Our partnered attorneys manage everything from filings to negotiations.
Copyright
What if my work isn’t copyrighted yet?
Your work is automatically protected under copyright law when created. Registration strengthens your legal position, which is why we recommend it.
Will you help with copyright registration?
Yes. If your work isn’t registered, we can guide you through the process, so your rights are as strong as possible before legal action.
Platforms & Coverage
What platforms do you target?
Primarily Amazon and Walmart – large marketplaces where counterfeits are common and where legal action is most effective.
What about sites like Redbubble, Etsy, or eBay?
We understand the frustration of seeing counterfeits there. While those sites don’t offer the same legal leverage, if you’re having problems on a specific site, let us know. If we can’t pursue it in court, we may still be able to help through DMCAs or cease-and-desist notices.
Control & Consent
Do I have to hand over rights to my work?
No. You retain full ownership of your copyright. We only need temporary legal permission to act on your behalf in the case.
Can I still sell or license my art while you’re working on the case?
Yes. You maintain control of your work and can continue licensing and selling.
What if I change my mind — can I back out?
Yes. You can withdraw consent at any point before a case is filed. After filing, withdrawal depends on legal timing, and we’ll talk you through options.
Communication
How often will I hear from you?
We’ll provide regular updates during each stage of the case.
If there’s ever a stretch with no new movement, we’ll still check in with you on a monthly basis, so you’re never left wondering.
Who should I reach out to if I have questions?
You’ll have a direct point of contact on our team.
Case Outcomes
What happens if we don’t win the case?
If damages aren’t recovered, you owe nothing. We absorb the costs of case building and legal work.
Will I still keep the copyright after the case ends?
Yes. You remain the legal copyright owner.
Do I get copies of legal documents or results?
Yes. You’ll receive documentation of filings, results, and recovery records for your case.
Time Commitment
How much of my time is needed?
About 6 hours total across the 9 to 12 month process.
Future Eligibility
Is this a one-time process, or can we work together again if more of my work gets stolen?
Absolutely. We’ll continue to help you as long as your work continues to be counterfeited.
Can I submit new designs for review down the line?
Yes. You can share new designs if you’d like them considered for future cases.
Tax
Will this affect my taxes?
Possibly. Edwin James represents artists in 65 different countries. Recovered damages can be considered taxable income. We recommend speaking with a tax professional in your local jurisdiction when you receive funds.
